Filtering is only lawful while the motorbike is travelling under 30 km/h. The road's speed limit must also be more than 40 km/h, so filtering is not lawful in a 40 km/h zone.

Where must a rider not lane filter?
Filtering past a parked vehicle is barred outright, and riding kerbside is not safe because that is where doors open and people step out. Other unsafe examples include a roundabout, a children's or pedestrian crossing, and filtering past a bus or a heavy vehicle.
